There was some talk about this right after the release of ROTK...this is what I remember learning, though it's been a while and I'm not 100% sure:
The rights to make the movie are all tied up. One company (I believe it is AOL Time Warner,which owns New Line, but I could easily be wrong) has the production rights: they have the rights to make the movie. Another company, MGM, I believe, has the distribution rights. They have met to try to work it out, but neither company seems willing to give up their side of the rights.
PJ has, I believe, expressed an interest in making the movie, but he has King Kong and another project in the works, so even if the rights were all sorted out, it might be a while
I don't see anything serious and big to do with The Hobbit happening until around 2008, at the very earliest and most optimistic...if it happens at all.
If you search the news archives on a site like theonering.net, you might find some more concrete info than I have given.
