As you are applying a legalistic approach to questions of moral culpability, it is probably pertinent to point out that, in most developed legal systems, there are special rules for addressing criminal acts on the part of minors and others of limited capacity. Generally, if a person lacks the capacity to appreciate (and therefore intend) the consequences of their action, there will not be a sufficent mental element (the
mens rea) to establish liability.
